Believe Tours and Travels Pvt. Ltd.

1. Applicability of the Agreement

This Terms of Use Agreement governs access to and use of the website, mobile application, and all other customer interaction channels operated by Believe Tours and Travels Pvt. Ltd. (hereinafter referred to as “Believe Tours”, “the Company”, “we”, “us” or “our”). These channels include, but are not limited to, websites, mobile applications, sales offices, call centres, advertisements, marketing campaigns, digital platforms, and customer support systems.

This Agreement applies to any individual or entity (“User”, “you”, or “your”) who accesses, browses, inquires about, or purchases any travel-related products or services offered by the Company, including but not limited to tour packages, air tickets, hotels, visas, transportation, holiday arrangements, or ancillary services.

The User and the Company are individually referred to as a “Party” and collectively as the “Parties.”

2. User’s Acknowledgement and Acceptance

1. By accessing or using any service of Believe Tours, the User confirms that they have read, understood, and agreed to be bound by this Terms of Use Agreement, which shall govern all transactions, interactions, and services provided by the Company.
   
   
2. If the User does not agree with any part of this Agreement, the User must immediately discontinue access to and use of the Company’s website, mobile application, and services.
   
   
3. All rights, obligations, liabilities, and responsibilities of the User and the Company shall be strictly limited to the scope of this Agreement.
   
   

3. Right to Modify or Terminate Access

Believe Tours reserves the right, at its sole discretion and without prior notice, to suspend, restrict, or terminate access to its website, mobile application, or any part of its services at any time for reasons including but not limited to system maintenance, security concerns, misuse, violation of this Agreement, or operational requirements.

4. Eligibility to Use Services

The use of the Company’s website or mobile application is permitted only to persons who are legally competent to enter into a binding contract under the Indian Contract Act, 1872.

Persons who are legally incompetent to contract, including minors, persons of unsound mind, or undischarged insolvents, are not eligible to use the services independently. Any use by such persons shall be deemed to be under the supervision and responsibility of a legal guardian.

5. License to Use Platform

Believe Tours grants the User a limited, revocable, non-exclusive, and non-transferable license to access and use the website or mobile application solely for lawful purposes and in accordance with this Agreement.

6. User Obligations & Prohibited Activities

While using the website or mobile application, the User agrees to the following:

• To make bookings only for legitimate travel purposes.
  
  
• Not to make speculative, false, fraudulent, or misleading reservations.
  
  
• Not to create bookings using fictitious names or false information.
  
  
• Not to interfere with, disrupt, or attempt to disrupt the functioning of the platform using any software, device, or method.
  
  
• Not to impose unreasonable or disproportionate load on the Company’s infrastructure.
  
  
• Not to upload, post, transmit, or distribute any content that is unlawful, abusive, defamatory, obscene, offensive, threatening, or otherwise violates applicable laws.
  
  
• Not to upload any content that infringes intellectual property rights, privacy rights, or proprietary rights of others.
  
  
• Not to transmit viruses, malware, or any harmful code that may compromise systems or data.
  
  

The User shall be solely responsible for any loss or damage arising from violation of these obligations.

7. Service-Specific Terms

Certain services offered by Believe Tours—such as air tickets, hotels, transport, visa services, holiday packages, MICE, rail or bus bookings—may be governed by additional terms and conditions prescribed by the respective service providers.

In case of conflict between such third-party terms and this Agreement, the terms of this Agreement shall prevail to the extent permitted by law. The User is responsible for reviewing and accepting the applicable service-specific terms before availing such services.

8. Acceptance Without Modification

All services provided by Believe Tours are offered strictly on the basis that the User accepts this Agreement and all applicable service-specific terms without modification. Availing any service constitutes unconditional acceptance of the same.

9. Account Registration & Security

1. During registration, the User may be required to create an account and choose login credentials.
   
   
2. The User is solely responsible for maintaining the confidentiality of their account, username, and password.
   
   
3. The User accepts full responsibility for all activities conducted through their account.
   
   
4. The User must immediately notify the Company in writing of any unauthorized use or security breach.
   
   
5. Believe Tours shall not be liable for any loss or damage arising from unauthorized access due to the User’s failure to safeguard credentials.
   
   

10. Access to Third-Party Platforms

By using the Company’s account access services, the User authorizes Believe Tours and its authorized partners to access third-party platforms such as banks, payment gateways, or service providers solely for processing transactions and retrieving required information.

11. Transaction Responsibility

Believe Tours is responsible only for transactions initiated and completed through its official platforms. The Company does not control or verify the legality or validity of transactions under the laws applicable to the User’s jurisdiction.

12. Compliance with Laws

The User agrees to comply with all applicable local, national, and international laws, regulations, and guidelines while using the Company’s services. The User shall be solely responsible for any violation of applicable laws.

13. Modification of Terms

Believe Tours reserves the right to modify, update, or amend this Terms of Use Agreement at any time. Continued use of the website or services after such changes shall constitute acceptance of the revised terms.

Fees & Payments

1. Service Fees & Charges
   Believe Tours and Travels Pvt. Ltd. reserves the right to levy service fees, convenience fees, transaction charges, or administrative fees for certain products or services offered through its website, mobile application, sales offices, call centers, or other customer interface channels. The Company may revise or update such fees from time to time without prior notice.
   The User agrees to bear all applicable charges, duties, government taxes, levies, and statutory assessments arising out of the use of the Company’s services.
   
   
2. Short Charging & Tax Variations
   In the event of any undercharging or incorrect charging due to technical error, system failure, human error, or any other reason, the Company reserves the right to recover the differential amount from the User after completion of the transaction.
   Any increase in pricing arising from changes in tax rates, imposition of new government taxes, fuel surcharges, supplier price revisions, or statutory levies shall be payable by the User.
   
   
3. Non-Confirmation of Reservations & Refunds
   In rare circumstances where a reservation is not confirmed due to reasons beyond the Company’s control, the Company shall process the applicable refund and inform the User accordingly. The Company shall not be obligated to provide an alternative booking, replacement service, or compensation.
   Any subsequent booking shall be treated as a new transaction, independent of the earlier unconfirmed reservation.
   
   

Requests for refunds relating to unutilized or “no-show” air tickets or hotel bookings must be submitted within 90 days from the date of flight departure or hotel check-in date, as applicable. Refunds, if any, shall be processed strictly in accordance with the policies of the respective airlines, hotels, and Believe Tours and Travels Pvt. Ltd.
No refund shall be payable for claims submitted after the expiry of the 90-day period, and any unclaimed amounts shall be deemed forfeited.

1. Special Offers, Promotions & Schemes
   Where bookings are made under promotional offers, special schemes, or discounted packages, additional terms and conditions shall apply. The User must strictly adhere to the payment timelines and eligibility criteria specified under such offers. Failure to comply may result in withdrawal of promotional benefits without any entitlement to compensation or refund.
   
   

Use of User’s Mobile Number & Contact Details

1. Transactional Communication
   Believe Tours and Travels Pvt. Ltd. may use the User’s registered mobile number, email address, or other contact details to send booking confirmations, itineraries, payment acknowledgements, cancellation updates, refund status, schedule changes, reminders, or any other transaction-related communication via SMS, voice calls, WhatsApp, email, or similar communication channels.
   
   

The Company may also contact the User to assist in completing an incomplete booking or to provide necessary support related to the User’s transaction.

1. Consent & Regulatory Compliance
   The User hereby expressly consents to receive such communications and acknowledges that these communications are:
   
   

• Authorized and requested by the User
  
  
• Transactional in nature and not unsolicited commercial communication
  
  
• In compliance with the guidelines of the Telecom Regulatory Authority of India (TRAI) and other applicable regulatory authorities
  
  

1. Indemnity for Incorrect Details
   The User agrees to indemnify and hold harmless Believe Tours and Travels Pvt. Ltd. against any losses, penalties, damages, or claims arising due to:
   
   

• Incorrect or invalid mobile numbers or email addresses provided by the User
  
  
• Erroneous complaints raised by the User with regulatory authorities regarding authorized transactional communications
  
  
• Any action initiated by telecom operators or regulatory bodies due to inaccurate User-provided contact details
  
  

FORCE MAJEURE CIRCUMSTANCES

1. The Client acknowledges that there may be exceptional and unavoidable circumstances under which airlines, hotels, transportation providers, cruise operators, or other independent service providers may be unable to honor confirmed bookings. Such circumstances may include, but are not limited to, natural calamities, adverse weather conditions, labor unrest, strikes, insolvency of service providers, pandemics or epidemics, governmental actions, regulatory restrictions, acts of terrorism, political disturbances, technical or operational issues, route changes, flight or service cancellations, or any other event beyond the reasonable control of Believe Tours and Travels Pvt. Ltd..
   
   In the event the Company receives advance notice of such circumstances, it shall make reasonable efforts to arrange suitable alternatives of a similar nature, subject to availability, or process a refund after deduction of applicable service charges, only if and to the extent that such amounts are refunded by the concerned service providers.
   
   The Client expressly agrees that Believe Tours and Travels Pvt. Ltd., acting solely as a booking facilitator, shall not be held responsible or liable for such force majeure events. Any further claims or resolutions must be pursued directly with the respective service provider.
   
   
2. The Client further agrees that in the event of any technical failure, system outage, network disruption, payment gateway issue, or other operational failure affecting the Company’s systems or platforms, the services committed earlier may be modified or may not be delivered as originally planned. In such cases, the Company’s sole obligation shall be limited to refunding the amount actually received from the Client for the affected service, after deducting applicable cancellation, refund, or administrative charges.
   
   Such refund, once processed, shall constitute full and final settlement of all claims against the Company, and the Client agrees that no additional compensation, damages, or claims shall be raised against the Company.
   
   
3. Believe Tours and Travels Pvt. Ltd. shall not be liable for any delay, partial performance, or non-performance of its obligations arising from causes beyond its reasonable control, including but not limited to acts of God, fire, flood, earthquakes, strikes, embargoes, war, acts of government, terrorism, or failures of airlines, railways, buses, hotels, or other transport or accommodation providers.
   
   In all such circumstances, the maximum liability of the Company, if any, shall be strictly limited to refunding the amount actually received by the Company for the specific service, less applicable charges. Under no circumstances shall the Company be liable for any indirect, incidental, consequential, special, or punitive damages, loss of profits, loss of data, or additional expenses incurred by the Client.
   
   
4. In no event shall Believe Tours and Travels Pvt. Ltd., its directors, employees, agents, or suppliers be liable for any direct or indirect damages arising out of or in connection with the use of the Company’s website, mobile application, sales channels, or services, whether based on contract, tort, negligence, strict liability, or otherwise.
   
   The Company shall also not be responsible for any errors, omissions, inaccuracies, or representations contained on its website, mobile application, promotional material, or any linked third-party platforms.
   
   

FEEDBACK, COMMUNICATION & SOLICITATION

1. The Client acknowledges that Believe Tours and Travels Pvt. Ltd. offers various travel-related services including, but not limited to, holiday packages, hotel bookings, transportation services, and customized travel solutions. In order to enhance the Client’s travel experience, the Client expressly authorizes the Company to contact them from time to time with information, updates, offers, promotions, and service-related communications.
   
   
2. Such communication may be made via telephone calls, SMS, WhatsApp messages, emails, direct mailers, or any other mode of communication using the contact details provided by the Client at the time of booking or registration.
   
   
3. The Client expressly consents that such communications are:
   
   
   • Authorized by the Client
     
     
   • Transactional and service-related in nature
     
     
   • In compliance with applicable laws, including guidelines issued by the Telecom Regulatory Authority of India (TRAI) or any other regulatory authority
     
     
4. In case the Client does not wish to receive promotional communications, the Client may opt out by submitting a written request to the Company through its official contact channels. However, essential transactional communications related to bookings, payments, itinerary updates, cancellations, or refunds shall continue to be sent.
   
   
5. The Client is advised to review and understand the Company’s Privacy Policy, which governs the collection, storage, usage, and sharing of personal information. Any communication, solicitation, or data sharing shall be conducted strictly in accordance with the Privacy Policy and applicable laws.

Responsibilities of the User in Relation to this Agreement

1. The User expressly understands and agrees that the use of any services provided by Believe Tours and Travels Pvt. Ltd. (“the Company”) is entirely at the User’s own risk. To the extent that the Company acts solely as a booking agent or facilitator for third-party service providers, the Company shall not be responsible or liable for the quality, standard, delivery, or performance of services rendered by such third parties.
   
   
2. All services are provided on an “as is” and “as available” basis. The Company does not guarantee uninterrupted access, error-free operations, or availability of services at all times and reserves the right to modify, suspend, or discontinue any feature or functionality of its services at its sole discretion, without prior notice.
   
   
3. The Company expressly disclaims all warranties, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, reliability, and non-infringement. Any information or advice received by the User, whether oral or written, shall not constitute any warranty unless expressly stated in writing by the Company.
   
   
4. If the User does not agree with any part of these Terms of Use, the User is advised to immediately discontinue accessing or using the Company’s website, mobile application, or any associated services. The User’s sole and exclusive remedy in such case shall be to cease usage and notify the Company in writing.
   
   

Updation and Accuracy of Information

1. The User acknowledges that while Believe Tours and Travels Pvt. Ltd. exercises reasonable care and diligence in providing information and services, certain content, descriptions, prices, or details available on the website, mobile application, promotional material, or sales channels may occasionally contain inaccuracies or typographical errors.
   
   
2. The Company reserves the right to correct, update, modify, or remove any such information at any time without prior notice. The Company may also enhance, modify, or discontinue any part of its digital platforms or services as it deems appropriate.
   
   
3. Any advice or information not received directly from an authorized representative of the Company should not be relied upon for decision-making purposes.
   
   

Modification of Terms of Use

1. Believe Tours and Travels Pvt. Ltd. reserves the right to revise, amend, or update these Terms of Use, including service charges and policies, at any time without prior notice.
   
   
2. Continued use of the website, mobile application, or services after such modifications shall constitute the User’s acceptance of the revised Terms. Users are advised to periodically review the Terms of Use.
   
   

Right to Refuse Service

1. The Company reserves the absolute right, at its sole discretion, to refuse, cancel, or discontinue any booking, request, or service without assigning any reason whatsoever.
   
   
2. No contractual obligation shall arise until full payment for the requested service has been received and accepted by the Company.
   
   
3. Without prejudice to other remedies available under law, the Company may restrict, suspend, or terminate a User’s access to its website, mobile application, or services, and may take appropriate legal action, in the following circumstances:
   
   a. If the User breaches or violates any provision of this Agreement, Terms of Use, or any applicable policies.
   b. If the Company is unable to verify or authenticate information provided by the User.
   c. If the User’s actions may infringe third-party rights, violate applicable laws, or expose the Company, its partners, or other users to legal or financial risk.
   
   
4. The Company may, at its sole discretion, reinstate a suspended User. However, a User whose access has been permanently suspended shall not attempt to re-register or access the services unless expressly permitted by the Company.
   
   
5. In the event of breach, the Company reserves the right to recover any outstanding dues and to initiate legal proceedings as deemed necessary.

RESPONSIBILITIES OF THE USER

1. The Client/User expressly agrees that the use of services offered by Believe Tours and Travels Pvt. Ltd. (“the Company”) is entirely at their own risk. The Company primarily acts as a facilitator or booking intermediary for services provided by independent third-party service providers.
   
   
2. The Company shall not be responsible or liable for the quality, performance, safety, standard, or deficiency of services rendered by airlines, hotels, transport operators, cruise companies, or any other third-party suppliers.
   
   
3. All services are provided on an “as-is” and “as-available” basis. The Company does not provide any warranties, whether express or implied, including but not limited to warranties of fitness for a particular purpose, merchantability, or non-infringement.
   
   
4. Any advice, guidance, or information provided orally or in writing shall not constitute a warranty unless expressly stated in writing by an authorized representative of the Company.
   
   
5. If the Client does not agree with these Terms of Use, the sole remedy is to discontinue the use of Company services after providing written notice.
   
   

UPDATION OF INFORMATION

1. The Company endeavors to ensure accuracy and reliability of all information published on its website, brochures, mobile applications, advertisements, and communication channels.
   
   
2. However, occasional inaccuracies, typographical errors, or omissions may occur. The Company reserves the right to correct, update, or modify information at any time without prior notice.
   
   
3. Any information or advice not received directly from an authorized Company representative should not be relied upon.
   
   

MODIFICATION OF TERMS

1. Believe Tours and Travels Pvt. Ltd. reserves the right to amend, revise, update, or replace these Terms & Conditions at any time.
   
   
2. Clients are responsible for periodically reviewing the Terms. Continued use of services shall be deemed acceptance of the revised terms.
   
   

RIGHT TO REFUSE SERVICE

1. The Company reserves the absolute right to refuse service, decline bookings, or cancel any transaction without assigning any reason.
   
   
2. A contract for services is deemed complete only upon receipt and acceptance of full payment by the Company.
   
   
3. The Company may suspend or terminate access to services if:
   
   
   • The Client breaches any Terms & Conditions
     
     
   • Information provided cannot be verified
     
     
   • The Company believes the Client’s actions may violate law or third-party rights
     
     
4. The Company reserves the right to initiate legal recovery for dues or damages where applicable.
   
   

CANCELLATION DUE TO INVALID INFORMATION

1. The Client undertakes to provide accurate, complete, and truthful information at all times.
   
   
2. If the Company discovers incorrect, misleading, or fraudulent information at any stage, it reserves the right to cancel bookings immediately without prior notice.
   
   
3. The Company shall not be liable for any loss arising from such cancellation, and the Client agrees to indemnify the Company against all claims arising thereof.
   
   

SAFETY OF DATA & DOWNLOADS

1. Any data, content, or material downloaded by the Client from Company platforms is done entirely at the Client’s own risk.
   
   
2. The Company shall not be responsible for damage to devices, data loss, or malware incidents, though reasonable precautions are taken to maintain platform security.
   
   

INTELLECTUAL PROPERTY RIGHTS

1. All content including logos, designs, text, images, videos, graphics, and software displayed on Company platforms are protected under intellectual property laws.
   
   
2. Clients may not reproduce, distribute, modify, transmit, or commercially exploit any content without written permission from the Company.
   
   
3. Unauthorized use may result in civil or criminal liability.
   
   

CONFIDENTIALITY

1. All business, operational, customer, supplier, and internal data of the Company is confidential.
   
   
2. Disclosure shall occur only where legally mandated or required for service delivery.
   
   

PERSONAL & NON-COMMERCIAL USE

1. Services and content provided by the Company are intended strictly for personal, non-commercial use.
   
   
2. Commercial exploitation, resale, or redistribution without written authorization is strictly prohibited.
   
   

FORCE MAJEURE

1. The Company shall not be liable for failure or delay in performance due to events beyond its reasonable control including but not limited to:
   
   
   • Natural disasters
     
     
   • Pandemics or epidemics
     
     
   • Government actions
     
     
   • Technical failures
     
     
   • Labor unrest
     
     
   • Airline or supplier insolvency
     
     
2. In such cases, the Company’s maximum liability shall be limited to refunding the amount actually received, subject to deductions imposed by suppliers.
   
   
3. No compensation for consequential or indirect losses shall be payable.
   
   

FEEDBACK & COMMUNICATION CONSENT

1. The Client authorizes the Company to contact them via phone, SMS, email, or digital channels for booking updates, service communication, or promotional information.
   
   
2. Such communication shall be treated as transactional and compliant with applicable telecom and data protection regulations.
   
   
3. Clients may opt out of promotional communication by submitting a written request.
   
   

JURISDICTION & ARBITRATION

1. All disputes shall be subject to Ahmedabad jurisdiction only.
   
   
2. Any dispute shall be resolved through arbitration conducted under Indian laws, with the arbitrator appointed by the Company.
   
   

VOLUNTARY PARTICIPATION & ACCEPTANCE

1. The Client confirms voluntary participation in travel services with awareness of inherent risks.
   
   
2. By physically or digitally confirming a booking, the Client confirms acceptance of all Terms & Conditions for themselves and all co-travelers.
   
   

INDEMNIFICATION

1. The User agrees to indemnify, defend, and hold harmless Believe Tours and Travels Pvt. Ltd., its directors, officers, employees, affiliates, partners, agents, representatives, website/mobile platforms, and lawful successors from and against all losses, liabilities, claims, damages, demands, penalties, costs, and expenses, including reasonable legal fees and interest, arising out of or related to:
   
   
   • Any breach or non-compliance by the User of these Terms & Conditions;
     
     
   • Any misrepresentation, omission, or incorrect information provided by the User;
     
     
   • Any violation of applicable laws, regulations, or third-party rights;
     
     
   • Any misuse of the Company’s services, website, mobile application, or booking systems.
     
     
2. The User shall be solely responsible for complying with the laws, customs, regulations, and codes of conduct of each destination country visited. The Company shall not be liable for any penalties, losses, or consequences arising from the User’s failure to comply with such regulations.
   
   

SEVERABILITY

If any provision of these Terms & Conditions is held to be invalid, unlawful, or unenforceable by a competent court or authority, such provision shall be severed to the extent of such invalidity, and the remaining provisions shall continue to remain valid, binding, and enforceable.

JURISDICTION & GOVERNING LAW

1. These Terms & Conditions shall be governed by and construed in accordance with the laws of India.
   
   
2. Believe Tours and Travels Pvt. Ltd. expressly submits itself to the exclusive jurisdiction of the courts at Ahmedabad, Gujarat, and no other court shall have jurisdiction over any disputes, claims, or proceedings arising out of or in connection with these Terms & Conditions, bookings, tours, or services provided by the Company.
